Conway files stay in sex offender case

FRANKFORT — Kentucky’s Attorney General is asking the U.S. Supreme Court to issue a stay in a controversial case involving the enforcement of living restrictions for convicted sex offenders.

Attorney General Jack Conway filed the request on Thursday. If the U.S. Supreme Court grants the stay, it would stop the enforcement of an October state Supreme Court ruling that said that restrictions on where sex offenders can live does not apply to those convicted before July 2006.

Conway had asked the state Supreme Court to issue a stay in the ruling, but the court declined his request on Monday. Since the state Supreme Court’s denial of the stay, the Department of Corrections is no longer enforcing the living restrictions for those convicted before July 2006. Under the 2006 law, sex offenders can not live near schools, playgrounds and daycare centers.

Conway has until Dec. 31 2009 to file an appeal with the U.S. Supreme Court. Conway is asking that the high court issue a stay until they decide whether to hear the case. Other state Supreme Courts have come to different pinions on the enforcement of living restrictions for sex offenders.

    Are my words meaningless? I said no ex post facto laws. What about that is so hard to understand.

    Smith v. Doe crossed the line, but at least still had heels on the line—it was arguable. Restrictions on where one may live are not public protection; they are punitive.

    Why is the public not outraged by this? Because sex offenders are “monsters”? Maybe some are, but what about those who pled to streaking in college? Are they the kind of decadents we have to protect ourselves against?
